The charge, which took place in or about mid-autumn festival in September 2015, was that a company which D1 was the sole director, sole shareholder, and sole signatory of the bank account thereof, handled proceeds of crime of a mooncake coupon scam. After an unsuccessful application for permanent stay of proceeding, D1 was convicted after trial. The Judge sentenced D1 to a prison term of 33 months.<br \/><br \/>In his Reasons for Verdict, the Judge said \u201c[62]. Further, the Judge did not make any reference to or mention of the Court of Final Appeal authority of \ud835\udc6f\ud835\udc82\ud835\udc93\ud835\udc8b\ud835\udc82\ud835\udc8f\ud835\udc8a \ud835\udc6f\ud835\udc82\ud835\udc93\ud835\udc86\ud835\udc94\ud835\udc89 \ud835\udc74\ud835\udc96\ud835\udc93\ud835\udc8d\ud835\udc8a\ud835\udc85\ud835\udc89\ud835\udc82\ud835\udc93 (2019) 22 HKCFAR 446 (which requires a court to consider the perception and\/or bias one may have).
